Terms of Service

1. The Seller

The Site is operated by Michael Sagato, a fine artist based in New York. References to “we,” “us,” or “the artist” refer to Michael Sagato.

2. Made-to-Order Prints

All prints sold on the Site are produced individually after your order is placed. Production typically takes 3–7 business days, followed by shipping. Estimated timelines are approximate and not guaranteed.

Because prints are made to order, all sales are final. Please review the full Shipping & Returns policy before purchasing.

3. Pricing & Payment

All prices are listed in U.S. dollars. Shipping is calculated at checkout. We reserve the right to change prices, substrates, or sizes offered at any time without prior notice. Payment is processed by a third-party payment provider; by placing an order you authorize the charge for the full order amount including shipping and any applicable taxes.

4. Order Acceptance

Submission of an order constitutes an offer to purchase. We reserve the right to decline, cancel, or refund any order at our sole discretion, including in the event of pricing errors, suspected fraud, or inability to fulfill. If we cancel an order before production begins, you will receive a full refund of the order total.

5. Intellectual Property

All paintings, images, written content, and design elements on the Site are the intellectual property of Michael Sagato and are protected under United States and international copyright law. Purchase of a print conveys ownership of the physical object only; it does not transfer copyright or any reproduction, distribution, or commercial use rights.

Prints are licensed for personal, non-commercial display only. For commercial licensing, please see the Licensing page.

6. Color & Display

Color rendering varies between monitors, substrates, and individual prints. On-screen previews are approximate. Slight variation between the on-screen image and the finished print is inherent to the medium and is not grounds for a refund or replacement.

7. Limitation of Liability

To the fullest extent permitted by law, our total liability arising out of or relating to any order shall not exceed the amount you paid for that order. We are not liable for indirect, incidental, consequential, or punitive damages of any kind.

8. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in New York County, New York.

9. Changes to These Terms

We may update these Terms at any time. Changes take effect when posted on the Site. Continued use of the Site after a change constitutes acceptance of the updated Terms.
